Ask Anne - Dog Custody
May 30, 2025

Question: “My husband and I are getting divorced. Can we share custody of the dog?”
Answer: Oh my goodness! I feel like King Solomon who announced the child should be cut in two so that each mother could have half!
First, this is not a “dog.” Instead, dogs are four-legged fur baby family members. Second, dogs are known to sense human emotions, including stress and anxiety. Therefore, your fur baby is already tense regarding the divorce. Don’t argue in front of pets as such events can affect their long-term health.
I would suggest you go to a mediator to determine an agreement of collaboration where the best interests of the pet is considered regarding vet care, travel plans, and a custody timeline. As with a child, consider them and their health first.
